* 현 시기 한반도는 사실상 전시상황과 다를 바 없는 심각한 위기에 직면하고 있습니다. 민권연대는 유엔 안보리 상임이사국을 비롯한 국제사회에 전쟁을 막고 평화를 실현하기 위한 호소가 절실히 필요한 때라고 생각합니다. 민권연대는 지난 3월 25일자로 유엔 안보리 상임이사국에 발송한 공개서한을 ‘영문서한’으로 번역하여 다시 보내고자 합니다.
 
[유엔 안전보장이사회 상임이사국에 보내는 공개서한]
 
유엔은 헌장 1조 1항에서 명시하고 있듯이 국제평화와 안전을 유지하기 위해 창설되었습니다.

특히 유엔 안전보장이사회(이하 안보리) 상임이사국을 맡고 있는 미국, 중국, 러시아, 영국, 프랑스 귀 5개국측은 국제평화와 안전에 대한 중요한 권한을 가지고 있습니다. 동시에 귀 5개국 측은 유엔 안보리 상임이사국 성원으로서 유엔 헌장을 가장 먼저 준수해야할 의무가 있습니다.

 그런데 최근 한반도는 귀 5개국측이 주도한 결정으로 심각한 핵 전쟁위기에 직면하고 있습니다.

얼마 전 대한민국 박근혜 대통령은 ‘핵을 머리에 이고 살수는 없다’고 강조했는데 정작 우리 국민 머리 위에는 미국 ‘B-52 핵 폭격기’가 날아다니며 실전 투하 훈련까지 하고 있는 상황입니다.
작년 여름 미국 측의 주도하에 한미연합 을지프리덤가디언 훈련에서 ‘핵선제타격’ 개념을 도입한 사실을 귀측들은 잘 알 것입니다. 북한은 이에 대응하여 이른바 ‘조국통일대전 계획’이라는 전면전 계획을 공식화하였습니다.
한마디로 지금의 한반도는 미국과 북한이 전면전을 앞두고 있는 심각한 상황이며 그 전쟁의 성질은 핵전쟁이라는 것입니다.

유엔의 제재에 대응한 북한의 입장은 ‘정전협정 백지화’이며, 북한은 미국을 겨냥한 ‘워싱턴 핵 타격’까지 경고한 상황입니다.
오늘의 위기는 한반도에 이어 세계적 대전으로 확전될 수 있는 그야말로 위험천만한 위기입니다.

유엔 안전보장이사회 상임이사국들은 현재 첨예하게 벌어지고 있는 한반도 문제의 본질이 무엇인지 잘 알고 있을 것입니다. 한반도의 문제는 1994년 ‘제네바협정’에서부터 2012년 ‘2.29합의’ 등 지속되어온 위기 과정 모두가 미국과 북한의 관계에서 비롯된 것입니다.

그런데 이러한 문제를 대하는 데서 유엔 안보리는 <결의 ‘825호’, ‘1695호’, ‘1718호’, ‘1874호’, ‘2087호’, ‘2094호’>라는 대북 제재만을 고수하는 일관된 방법으로만 해결하고자 했습니다. 이는 모두 미국의 요청으로 시작된 결과물입니다. 유엔 안보리는 사실상 일방적으로 미국의 손을 들어주며 해결을 보려고 했습니다. 공정성의 논란이 충분히 있는 대목이 아닐 수 없습니다.

그렇다면 이러한 불공정성이 내재된 ‘제재’가 과연 어떠한 효과를 거두고 해결을 보았는지 되묻지 않을 수가 없습니다.
과연 유엔 안보리 제재 이후 단 한번이라도 평화와 안정이 보장된 적이 있습니까? 한반도는 유엔 대북제재가 있고나면 언제나 심각한 전쟁위기를 겪어야 했습니다. 유엔 안보리 상임이사국이 문제 해결의 의지가 있다면 이제 다른 방안을 강구해야 할 때입니다.
 
유엔 헌장 2조 1항은 모든 회원국의 주권평등의 원칙을 명시하고 있습니다. 이 조항은 국제평화와 안전이 국제사회 구성원들이 상호 존중하며, 상대방의 권리를 침해하지 않아야 성립할 수 있다는 것을 의미합니다.
유엔 안보리 상임이사국은 인공위성 발사든, 군사적 행동이든, 경제 주권 문제든 국제사회의 아무런 제재도 받지 않아 왔습니다. 반면에 그렇지 못한 다른 약소국가들은 언제나 불평등한 대우를 받아왔습니다. 이는 명백히 패권적인 전횡이 아닐 수 없습니다.
 
유엔은 본래의 정신을 회복하여 합리적이며 이성적인 판단으로 국제사회의 평화와 안정에 기여해야만 합니다.

현 시기 대한민국에서는 유엔안보리 상임이사국 성원인 미국이 핵폭격기와 핵잠수함을 가지고 와서 60여 일 동안 무려 20만 대군을 동원하는 한미연합 키리졸브-독수리 연습을 전개하고 있습니다. 더군다나 이 훈련의 작전계획에는 핵시설 정밀타격이라는 내용까지 담겨져 있습니다.
이러한 군사훈련은 유엔 안보리에서 취한 대북 제재와 결합되며 한반도 전쟁위기를 더욱 부채질 하고 있습니다.

 이런 위기 속에서 유엔 안보리는 사실상 대북 군사 제재 직전단계인 유엔 헌장 7조 41항으로 이루진 ‘유엔 안보리 결의 2094호’ 다음으로 유엔 헌장 7조 42항을 적용한 군사적 제재조치에 돌입할 수도 있다고 언급 했습니다. 이러한 유엔 안보리의 입장에 대해 북한은 제재에 대응한 제2, 제3의 조치를 계속 취한다고 했습니다.
 결국 유엔 안보리 상임이사국들이 주도한 군사적 제재조치는 한반도에 개전을 선언하는 꼴과 다름없게 될 것입니다.

대한민국 국민은 평화를 원합니다. 그러나 우리 대한민국 국민의 생명과 재산을 모두 앗아갈 전쟁의 결정을 유엔 안보리 상임이사국 5개국 측들이 내린다는 것은 도저히 용납할 수 없는 일로 될 것입니다.
 
유엔 안보리 상임이사국을 비롯한 안보리 주요 성원국들은 전쟁을 부추기는 제재를 즉각 거두고 대화와 협상의 환경을 보장해야할 것입니다.

 우리는 유엔 안보리 상임이사국들이 내린 결정들이 비합리적이며 반인륜적인 조치로 불거질 수 있다는 것을 직시해야 한다고 촉구하며, 하루속히 이성적이며 평화적인 조치를 취할 것을 강력히 요구하는 바입니다.

The Letter to United Nations Security Council Permanent Members
 
To whom it may concern,
 
UN was found to maintain international peace and security as Article Ⅰ clause Ⅰ of UN charter clearly stipulates. Especially the five veto-wielding permanent members of Security Council, including your country, have strong power to decide important case related to peace and security of the world. On the other hand, it is a duty of the five members to take the lead in observing the UN Charter.

As you know, Korea is facing a critical situation of a nuclear war that comes from sanctions measures on North Korea passed under the lead of your five countries. NK declared 'Rescind Korean War cease-fire agreement' coping with UN sanctions and also warned Washington nuclear strike aiming at the United States. This crisis today, indeed, is perilous situation which can escalate into World War Ⅲ from Korean War Ⅱ.
 
Furthermore, U.S. introduced 'A Nuclear Preemptive Strike' in Ulchi-Freedom Guardian of the ROK(Republic of Korea)-U.S. CFC(Combined Forces Command) in last summer. In response to this, NK officially announced 'Nation's Re-unified Plan'.

President Park in South Korea said that we couldn't live with putting nuclear bomb on the head, but we are living with a B-52 nuclear bombing plane on the head and even the fighter is dropping bombs on the pretext of training. That is to say, Korea is strained to the point where any slight incident could touch off the hostilities, and the type of hostilities will be a nuclear war.
 
The UNSC five permanent members know the heart of this Korean matter. The root of the problem has originated from the relation between U.S. and NK from Geneva conventions in 1949 to 2.29 Agreement in 2012. However, the UNSC has clung to that sanctions like 'Resolutions 825, 1695, 1718, 1874, 2087, and 2094' are only solutions with respect to this issue. It all started with requests from U.S., and the UNSC has took the side with U.S. unilaterally. Then we should ask how these unfairness sanctions impacted with solve the tense situation. As you know, those resolutions have never brought peaceful atmosphere to Korean Peninsula, instead, everytime UNSC passed resolution on sanctions, Korea has always suffered serious war crisis. Eventually, nobody think sanctions measures on NK are fair and right ways to solve the problem and keep the peace. If the five UNSC permanent countries have will to keep the international peace, you must figure out the other solution.

Article Ⅱ clause Ⅰ of UN Charter states the sovereign equality of all its Members. This provision means that international peace and security can be done only when the members of the international community mutually respect each other and don't violate others' right. The five permanent members have never faced sanctions on either satellite launching or military actions, while other weak states always have received unequal treatment about their right of self-defense. It is obviously strong states' hegemonism which is against the spirit of UN. UNSC must recover the original spirit of UN and contribute to the international peace and stability with rational judgement.
 
Now in South Korea, U.S. is under training the ROK-U.S. Key Resolve-Eagle Practice mobilizing more than 200,000 soldiers for 60 days with nuclear bombers and nuclear submarines from the continental United States. These military exercises, combined with sanctions UN passed, is provoking the war crisis in Korea. In such circumstances, UNSC has mentioned that UN may take a measure of military sanctions to NK after 'UNSC Resolution 2094', and NK also announced the second and third treat would be made in respond to this sanctions. After all, military sanctions led by the UNSC permanent members could result in declaring war not only in Korea, but also in the world.

Korean people want peace. We cannot accept that five permanent UNSC members will make a decision which can call for severe consequences to the Korean and innocent people in the world. The major members of UNSC including permanent members must drop hard line policy that sticks to the sanctions, and make the atmosphere for communication and negotiation.

Again, we argue that five permanent UNSC members must realize that unequal and irrational decision could produce the cruel result that against humanity, and strongly urge that the members will take an rational and peaceful action for keeping international peace and security.
